Terms of Service

Golazo is a football quiz game published and distributed by Variko Inc (“we,” “us,” or “our”), a company incorporated in the United States.

The Service includes the Golazo game, the Golazo website (golazoapp.io), the Golazo mobile applications for iOS and Android, and all related features (quizzes, the World Draft, streaks, daily challenges, and any other functionality we provide).

These Terms also serve as the End User License Agreement (“EULA”) governing your installation and use of the Golazo mobile applications. Additional platform-specific terms for Apple App Store and Google Play users are set out in Section 16 below.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have parental or guardian consent.

Golazo does not use accounts. When you first open the app, an anonymous profile is created for your device, and your progress is tied to that device. You may optionally set a display name and a country flag.

• Your profile is tied to your device and cannot be transferred to another device.
• You are responsible for any display name you choose; offensive, misleading, or infringing names may be rejected or removed by automated moderation or by us.
• Subscriptions are linked to your App Store / Google Play account and can be restored on a new device via “Restore purchase”.

By using the Service, you agree not to:

• Use bots, scripts, cheats, exploits, or any form of automation
• Exploit bugs or glitches instead of reporting them
• Attempt to reverse-engineer, decompile, or disassemble the Service
• Interfere with or disrupt the Service, its servers, or its APIs
• Use the Service for any unlawful purpose

We reserve the right to take action against profiles that violate these rules, including resetting progress and temporarily or permanently suspending access to the Service.

All content and materials available through the Service, including but not limited to the game design, software, graphics, animations, user interface, question content, text, logos, and audio, are the property of Variko Inc or its licensors and are protected by applicable intellectual property laws.

Any third-party names, trademarks, logos, or images appearing in the Service — including the names of football players, clubs, leagues, and competitions referenced in quiz content — belong to their respective owners. Their inclusion is for informational and entertainment purposes only and does not imply any affiliation with or endorsement by those parties.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

The Service offers an optional auto-renewing subscription (the “Golazo Subscription”) that unlocks all themes. The payment processor and applicable terms depend on the platform you purchase on.

6.1 Payment Processors

Apple App Store (iOS). When you purchase a subscription through the Golazo iOS application, the transaction is processed by Apple using In-App Purchase (StoreKit). Your payment, billing, and tax handling are governed by your Apple ID account and Apple's Media Services Terms.

Google Play (Android). When you purchase through the Golazo Android application, the transaction is processed by Google through Google Play Billing and is governed by the Google Play Terms of Service.

On both platforms we use RevenueCat as a service provider to validate receipts and synchronise your entitlements (such as subscription status) with your Golazo profile; RevenueCat does not process the payment itself.

6.2 The Golazo Subscription

The Golazo Subscription is auto-renewing. Unless cancelled before the renewal date, your subscription will automatically renew at the end of each billing period and you will be charged the then-current price. The length of the subscription, the price per period, and any free-trial details are disclosed in the purchase sheet presented at checkout.

iOS subscriptions — Apple required disclosures:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price disclosed to you at sign-up (or the then-current price for the renewal term).
• You can manage your subscription and turn off auto-renewal at any time from your Apple ID Account Settings. Cancellations take effect at the end of the current billing period; you retain subscription access until then.
• If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription, where applicable.

Android subscriptions. You can manage and cancel Android subscriptions through the Google Play Store app under Subscriptions → Golazo. Renewal terms (charge date, auto-renewal, and cancellation cut-off) follow Google Play's standard rules, which are disclosed at checkout.

6.3 Refunds

Apple App Store purchases. All refund decisions for purchases made through the App Store are made by Apple in accordance with Apple's policies. We are not able to issue refunds for App Store transactions directly. To request a refund, visit reportaproblem.apple.com and follow Apple's instructions.

Google Play purchases. Refunds for purchases made through Google Play are governed by Google's refund policies. You can request a refund through the Google Play Store within the eligibility window set by Google.

6.4 Pricing & Taxes

Prices are displayed in your local currency where possible. Applicable taxes (including VAT and sales tax) are handled by Apple or Google respectively, in accordance with your jurisdiction. Final pricing including tax is shown at checkout.

Streaks, scores, unlocked themes, and any other in-game progress or virtual items have no real-world monetary value and cannot be exchanged, traded, sold, or transferred outside of the Service. We reserve the right to modify, remove, or adjust virtual content at any time without prior notice or liability.

You are solely responsible for any content you submit, including your display name. You agree not to submit content that is offensive, defamatory, obscene, infringing, or otherwise objectionable. We reserve the right to remove any content and take action against profiles at our sole discretion.

We strive to keep the Service available and running smoothly, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

• Modify, update, or discontinue any aspect of the Service at any time
• Perform maintenance that may result in temporary downtime
• Reset game data or streaks as part of normal operation
• Change game mechanics, rules, rewards, or balancing

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time from the app's settings or by contacting us at [email protected]. Termination does not entitle you to any refund of purchases made prior to termination, except where required by applicable consumer protection law.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of errors or defects.

To the fullest extent permitted by law, Variko Inc and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service. Our total aggregate liability shall not exceed the amounts you have paid to us in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Variko Inc, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

The following additional terms apply to your installation and use of the Golazo mobile applications obtained through the Apple App Store or Google Play. They supplement, and do not replace, the rest of these Terms.

16.1 Apple App Store

You acknowledge and agree that:

• Parties to the EULA. These Terms are a binding agreement between you and Variko Inc only, and not with Apple Inc. (“Apple”). Variko Inc, not Apple, is solely responsible for the Golazo iOS application and its content.
• Scope of license. The license granted to you for the iOS application is limited to a non-transferable license to use the application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms, except that the application may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing where applicable.
• Maintenance and support. Variko Inc is solely responsible for providing any maintenance and support services for the Golazo iOS application. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the iOS application.
• Warranty. Variko Inc is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the iOS application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the iOS application to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the iOS application.
• Product claims. Variko Inc, not Apple, is responsible for addressing any claims by you or any third party relating to the iOS application or your possession and/or use of it, including product liability claims, claims that the application fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar legislation.
• Intellectual property rights. In the event of any third-party claim that the iOS application or your possession and use of it infringes that third party's intellectual property rights, Variko Inc, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of the claim.
• Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Developer contact. If you have any questions, complaints, or claims with respect to the iOS application, you can contact Variko Inc at [email protected] or by mail at the address in Section 1.
• Third-party terms. You must comply with all applicable third-party terms of agreement when using the iOS application (for example, your wireless data service agreement).
• Apple as third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms as they relate to your license of the iOS application, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16.2 Google Play

These Terms govern your use of the Golazo Android application between you and Variko Inc only, and not Google LLC (“Google”). Variko Inc, not Google, is solely responsible for the Android application and its content. Maintenance, support, warranty, product claims, and intellectual-property claims relating to the Android application are the sole responsibility of Variko Inc, on the same terms as set out in Section 16.1 above (reading “Google” for “Apple” and “Android application” for “iOS application” where applicable). Your use of the Golazo Android application is also subject to the Google Play Terms of Service.
